Vaccination of educators is optional, but an unvaccinated teacher may not be allowed to work, RBC Novosibirsk was told in the Education Department of the Novosibirsk City Hall.
When deciding on the mandatory vaccination for teachers, the following legal algorithm applies, which RBC Novosibirsk outlined in the department.
Vaccination against CORONAVIRUS infection is included in the national vaccination calendar for employees of educational organizations. Vaccination against coronavirus infection is voluntary.
At the same time, according to paragraph 2 of Art. 5 157-FZ "On Immunization of Infectious Diseases", the absence of mandatory preventive vaccinations entails a refusal to hire or dismissal from work, the performance of which is associated with a high risk of contracting infectious diseases.
Based on this requirement, the administration of the school or other educational institution is obliged to remove the teacher from work under Art. 76 of the Labor Code of the Russian Federation for the entire period of time until the elimination of the circumstances that served as the basis for suspension or exclusion from work.
