Based on the results of laboratory monitoring of the quality and safety of food products, in 2021 the ROSSELKHOZNADZOR Office for the Bryansk, Smolensk and Kaluga regions issued 146 orders to terminate declarations of conformity for various MEAT, dairy and fish products, feed of plant origin.
To date, 131 declarations of conformity have already been terminated. The rest of the declarations will be terminated within the time limits allotted by law.
In all cases, the basis for the application of such measures by the Department of Rosselkhoznadzor was the various inconsistencies established as a result of laboratory testing of samples of products of animal origin with the requirements of the technical regulations of the Customs Union in terms of quality and safety.
Samples of products for research were taken directly from manufacturers, in places of sale, as well as in budgetary institutions of the regions. At the same time, sampling was carried out, including taking into account the analysis of risks obtained on the basis of identified violations during the monitoring of the FSIS "Mercury" on the discrepancy between the volumes of incoming raw materials and the finished products produced, its illogical movement, the lack of indication of the raw materials from which the products were manufactured, and a number of other violations.
Thus, as a result of studies conducted in the Bryansk Interregional Veterinary Laboratory and the Federal State Budgetary Institution "CNMVL" subordinated to the Rosselkhoznadzor, inconsistencies in the samples were revealed in terms of the presence of residual content of drugs and preservatives, microbiological indicators, signs of falsification, as well as microbial transglutaminase.
Measures to suppress the production and circulation of products in the form of the cancellation of declarations of conformity were applied to fish products, butter, cheese, drinking MILK, powdered milk, condensed milk, sour cream, fermented baked milk, yogurt, cottage cheese, sausages and meat by-products produced by enterprises of the Bryansk, Vladimir, Voronezh, Ivanovo, Kaluga, Kemerovo, Kursk, Lipetsk, Moscow, Nizhny Novgorod, Novosibirsk, Novgorod, Penza, Ryazan, Saratov, Smolensk, Tambov, Tula and Chelyabinsk regions, the Republic of Tatarstan, St. Petersburg, as well as the Republic of Belarus .
In all cases, the Office of the Rosselkhoznadzor issued orders to terminate the validity of declarations of conformity for the release of these products.
At the same time, information about the discrepancy between the products of Bryansk manufacturers was received by the Office of the Rosselkhoznadzor from other regions. So, in 2021, the Voronezh regional movement for the protection of consumer rights “The Quality of Our Life” received complaints about the quality of products of Brasovskie Syry LLC, Bryansk Dairy Plant OJSC and Trade House Dubrovkamoloko LLC.
In addition to the cancellation of declarations, legal entities and officials of enterprises that allowed the release of products that do not meet regulatory requirements were brought to administrative responsibility 65 times under Articles 14.43 and 19.5 of the Code of Administrative Offenses of the Russian Federation. The total amount of fines amounted to 9 million 922 thousand rubles.
So, for example, according to the statement of the Office of the Rosselkhoznadzor for the Bryansk, Smolensk and Kaluga regions, by the decision of the Arbitration COURT of the Bryansk region of October 13, 2021, LLC Torgovyi House "Dubrovkamoloko" The reason for this was the identification of vegetable oils and vegetable-based fats (campesterol, stigmasterol, beta-sitosterol) in the product “Krestyanskoye sweet-creamy unsalted butter, mass fraction of fat 72.5%”, as well as non-compliance with the requirements of GOST.
At the same time, the Office of the Rosselkhoznadzor draws the attention of economic entities that in the event of a repeated commission of an administrative offense under Part 2 of Art. 14.43 of the Code of Administrative Offenses of the Russian Federation, they may be sanctioned already by part 3 of this article, the punishment for which is the imposition of a large administrative fine, or an administrative suspension of activities for up to 90 days with confiscation of the objects of an administrative offense.
At present, the Office of the Rosselkhoznadzor has sent 3 materials to the courts, part 3 of Art. 14.43 of the Code of Administrative Offenses of the Russian Federation for the suspension of activities.
At the same time, the Rosselkhoznadzor Administration recalls that in the territory of the Russian Federation, the circulation of food products in the absence of a valid declaration of conformity is prohibited and threatens violators with a large fine.
