The new court again did not give the word "Kostroma" to Kostroma Meat Processing Plant LLC

The courts over and over again recognize the meat-packing plant's arguments as "untenable", but the latter does not let up.

Kostroma MEAT Processing Plant LLC , which has been suing the Internet portal KOSTROMA.TODAY since March of this year, lost another COURT case.

This time, the arguments of the meat  -packing plant were recognized by the Second Arbitration Court as “completely untenable”.   This is the next instance after the Kostroma arbitration, where Kostroma Meat Processing Plant LLC has already lost the claim.

Recall that our note became the reason for the proceedings - it was about an inspection that was carried out at the beginning of the year by the ROSSELKHOZNADZOR department . Then, at one of the Kostroma meat-packing plants  , traces of soy were found in the sausage .

Despite the fact that the name of the enterprise was clearly indicated in the text, Kostroma Meat Processing Plant LLC  for some reason decided that it was about him.

After that, the company, headed by Ruslan Shakhbanov, filed a lawsuit to protect business reputation. From the text of the claims, it can be understood that the  combination of the words “Kostroma” and “meat processing plant”,  even in cases where the text refers to another enterprise,   still refers to Kostroma Meat Processing Plant LLC.

As we have already said, the Arbitration Court of the Kostroma Region  completely dismissed the claim in June , noting that the expression “Kostroma meat processing plant” refers only to a plant that operates on the territory of the Kostroma Region and  can refer to many enterprises.

Now the Second Arbitration Court agreed with this position.

 “The plaintiff's claims are based only on the subjective perception of what was read. The information [published in the note] did not relate to the plaintiff at all,”  commented lawyer Ekaterina SHMYGINA, who represented the interests of the Internet portal in courts.

In parallel with this court, the company's marketer Vladislav Golubev also filed a lawsuit for the protection of honor and dignity and  demanded compensation for non-pecuniary damage in the amount of 100 thousand rubles  - the case was considered in the Leninsky District Court. In early June, the court  completely denied his claims. Later, in September, the  Kostroma regional court refused him again.

Thus, Kostroma Meat Processing Plant LLC and its employee have already lost four court cases.

It should be noted that according to the data of the Department of Agroindustrial Complex of the Kostroma Region, more than 76 enterprises are engaged in meat processing in the region.
