ChMPZ is suing the Tula Meat Processing Plant because of the Imperial sausage

According to the data published in the file of arbitration cases, ChMPZ is seeking compensation from the defendant as the exclusive right holder for the trademark "Imperial" in the category of sausage products.

Sausage under the name "Imperial", produced by Tula MEAT Processing Plant LLC, was sold in the SPAR supermarket chain in 2019-2022. The ChMPZ statement states that during this period, the income from the sale of 44,107 kilograms of the disputed product, including VAT, amounted to about 496,528 rubles. Invoices and checks are attached to the file, reflecting the discrepancy between selling and consumer prices (retail exceeds purchase by 65 times). 

Based on the fact that the counterfeit goods were delivered to the retailer at a clearly lower price (11.26 rubles per kilogram compared to 739.9 rubles per kilogram in retail), lawyers suggested that in fact the Tula Meat Processing Plant and SPAR Tula LLC control one and the same thing. same face.

The conflict between ChMPZ and the Tula Meat Processing Plant began in August 2022. At the moment, SPAR Tula LLC has been brought to the case as a co-respondent. The next meeting of the Arbitration COURT will take place on March 16.
