The Court of Appeal upheld the refusal to pay compensation to the Central company

The ASF outbreak in the Nikiforovsky District of the Tambov Region occurred at the end of April 2021. During the elimination of the outbreak, veterinary services seized livestock from the Otkorm, Reproduktor, and Plemennaia ferma sites — a total of about 40 thousand animals. The companies were denied compensation due to four violations of veterinary legislation identified two months before the outbreak. 

In December 2023, the COURT of first instance found only two of them proven and partially (50%) satisfied the claim of Centralnoye LLC for recovery of economic damages against the Tambov Region Veterinary Department (initially, the plaintiff tried to recover 242.8 million rubles in damages and 23.2 million rubles in interest from the department). The defendant filed an appeal.

Unlike the regional arbitration, the 19th Arbitration Court of Appeal found all four episodes proven and ruled that compensation for violators of veterinary legislation was not provided for.
