July 1, MINSK . In Belarus, a license is required for the sale of non-tobacco nicotine-containing products and liquids for electronic smoking systems from July 1, BelTA learned from the Ministry of Taxes and Duties.

In accordance with the law "On Licensing", from January 1, 2023, licensing of retail trade in non-tobacco nicotine-containing products and liquids for electronic smoking systems was introduced. Transitional provisions are also provided for the possibility of obtaining a license.

"Business entities that retailed such goods as of January 1 were entitled to continue their activities without a license until July 1. If they intend to trade in such goods in the future, they had to obtain a license for the retail sale of alcoholic beverages, tobacco products, non-tobacco nicotine-containing products, liquids for electronic systems," the ministry said.

If such a license already existed as of January 1 (with an indication of the “retail sale of tobacco products” service component of the licensed activity) and the sale of non-tobacco nicotine-containing products, liquids for electronic smoking systems was also going on at that time, the business entity was entitled to continue to carry out such activities, however, was to send a notification to the licensing authority before July 1, 2023 in the form established by MART. If there was no license, it was necessary to ensure its availability from July 1, 2023.

"Business entities that have not complied with the requirements of the law, from July 1, are not entitled to retail non-tobacco nicotine-containing products, liquids for electronic smoking systems," the Ministry of Taxation stressed. If it was not planned to continue trading in such goods, it was necessary to sell the balances before July 1.

Retail trade in non-tobacco nicotine-containing products, liquids for electronic smoking systems, carried out without a license, entails administrative (part 1, article 13.3 of the Code of Administrative Offenses) or criminal (article 233 of the Criminal Code) liability.
