The Office of the ROSSELKHOZNADZOR for the Republic of Mordovia and the Penza Region brings to the attention of economic entities information that, in accordance with Art. 52 of the Federal Law of July 31, 2020 No. 248-FZ, control authorities can carry out preventive measures in the form of a preventive visit.
A preventive visit is carried out by the inspector in the form of a preventive conversation at the place of activity of the controlled person or by using video conferencing. During a preventive visit, the controlled person is informed about the mandatory requirements for his activities or objects of control belonging to him, their compliance with the risk criteria, the grounds and recommended ways to reduce the risk category, as well as the types, content and intensity of control (supervisory) measures, carried out in relation to a controlled person based on its assignment to the relevant risk category.
Mandatory preventive visits in the field of grain quality and safety are provided only for controlled entities engaged in the production, storage, transportation, sale of grain, as well as its laying, storage and transportation as part of the state reserve, and who have just begun to carry out activities in this area , but no later than one year from the start of such activities, as well as classified as high-risk categories. The enterprise is notified about the mandatory preventive visit no later than 5 working days in advance and has the right to refuse it no later than 3 working days.
Also, legal entities and individual entrepreneurs can, on their own initiative, invite an inspector exercising control in this area to conduct a preventive visit and receive advice.
During a preventive visit, the supervised person may not be issued orders to eliminate violations of mandatory requirements. The explanations received during the preventive visit are advisory in nature.
If an economic entity is interested in conducting a preventive visit, it must make an application in writing indicating the scope of legislation, as well as questions of interest to which it would be desirable to receive answers.
