There is no legal possibility to return the death penalty in RUSSIA, Andrei Klishas, ​​head of the Federation Council Committee on State Construction, said in an interview with RBC.

“The Constitutional COURT formulated these decisions in such a way that, in fact, today the right not to be sentenced to death refers to guarantees of rights and freedoms. There is no format that allows you to overcome this decision, ”the senator believes. At the same time, theoretically, nothing can be ruled out, Klishas noted: a new constitution can be adopted, and the death penalty can be restored, but this is a “theoretical speculative construction” that has nothing to do with reality. “I don’t see such a possibility legally,” he stressed, suggesting that the introduction of the death penalty would most likely require a change in the constitution.

“Admit it, after all, the state does not have the right to execute people,” Klishas believes. “But if you ask people, I think most people will say that in some cases it can.” However, according to the senator, statistics show that the execution does not affect the criminogenic situation for grave and especially grave crimes, and judicial errors are possible.
