The ex-head of MUP Ufa will be checked because of the accusation of withdrawing 1.5 billion to his company

In the case on the claim of the Municipal Unitary Enterprise “Customer and Technical Supervision Service” (“SZ and TN”) of Ufa against the former DIRECTOR of the enterprise Timur Giniyatullin for the recovery of 1.49 billion rubles in losses, an examination was appointed. The case is being considered in the Arbitration COURT of Bashkiria.

The company accused its ex-head of concluding an unprofitable contract with an affiliated firm, follows from the case file. According to the plaintiff, in 2020, Giniyatullin, as director of the Municipal Unitary Enterprise SZ and TN, signed agreements with Specialized Developer Garantstroyinvest LLC on equity participation in the construction of the Mendeleevsky residential complex in Ufa. The object was not completed, therefore, the company suffered losses.

“The plaintiff’s claims are motivated by the conclusion by the defendant on behalf of the SZiTN enterprise of agreements for participation in shared construction with SZ Garantstroyinvest LLC on extremely unfavorable conditions for the enterprise, which actually lead to the withdrawal of the enterprise’s liquid assets in favor of the organization controlled by the defendant — the Garantstroyinvest company,” stated in the ruling of the Arbitration Court of Bashkiria.

At the request of the plaintiff, the court appointed an examination, which should establish the cost per square meter of residential and non-residential premises in the Mendeleevsky Residential Complex under construction. The expert also needs to find out how much the same property is worth with the condition of deferred payment for 2021 and 2024. Consideration of the claim is suspended until the results of the study are received.

As RBC Ufa reported, the Municipal Unitary Enterprise "Customer and Technical Supervision Service" filed a lawsuit against the former director of the enterprise in September 2021. According to the company, Timur Giniyatullin, while managing the municipal enterprise, caused damage to it by almost 1.5 billion rubles.

Giniyatullin headed the municipal enterprise from February 2020 to June 2021. In March 2021, it became known that the Ministry of Internal Affairs of Bashkiria was checking the circumstances of the withdrawal of the assets of MUP SZ and TN.

The enterprise was founded in 2001 and is subordinated to the administration of Ufa. MUP "SZ and TN" has a 100% subsidiary LLC "Customer Service". This company, in turn, owns shares in Novaya Kompaniya LLC, City Real Estate Center LLC and Center for the Development of Perspective Projects LLC.

SZ Garantstroyinvest LLC was established in 2017. The co-owners of the company are Boris Borisov and Konstantin Serdyuk. 10% in the authorized capital belongs to MUE "SZ and TN". Andrey Kostin is the General Director of the enterprise.

The residential complex "Mendeleevsky", located in the quarter bounded by Mendeleev, Kuvykin and Bakalinskaya streets in Ufa, is being completed by changing the developer by the republic at the expense of the regional budget. Some of the buildings of the residential complex were commissioned and occupied until 2011, while others still remain unfinished. The developer, PHC Mercury LLC, was declared bankrupt in May 2019. Currently, work at the facility is being carried out by the Municipal Unitary Enterprise "Customer and Technical Supervision Service" of Ufa.

In February 2022, a group of equity holders of the LCD recorded a video message to the Chairman of the Investigative Committee Alexander Bastrykin with a request to investigate the circumstances of the construction of the facility and the use of citizens' funds. They stated that in 2019–2021, the management of MUP SZ i TN had withdrawn equity participation agreements at reduced prices to LLC SZ Garantstroyinvest. The Investigative Department of the TFR for Bashkiria then reported that these arguments were being checked.
