Aeroflot was obliged to return money to Perm residents for a disrupted trip

The Perm Regional COURT upheld the decision of the Dzerzhinsky District Court to recover from Aeroflot PJSC money for canceled flights and compensation for non-pecuniary damage. This was reported by the press service of the court.

Recall that a resident of Perm filed a lawsuit against Aeroflot PJSC to recover funds for canceled flights and compensation for moral damage. In support of the claim, the man indicated that in January 2020 he purchased air tickets for himself and his family members with a departure date of April 8, 2020 on the route Perm-Moscow, Moscow-Bangkok and back for a total amount of 117 thousand rubles, but in connection with the introduced Due to restrictions during the spread of CORONAVIRUS infection, the above flights were canceled.

The plaintiff repeatedly applied to the airline with a demand for the return of the paid carriage fee and, as a result, used part of the amount paid - 94.9 thousand rubles for the canceled flight as payment for a new air transportation. This time the family vacation was planned in Turkey. But even in May, it was not possible to spend a long-awaited vacation at sea. By decision of the headquarters for the prevention of the importation and spread of covid-19 of the Government of the Russian Federation, regular and charter flights were limited, the flight was canceled again. After that, the resident decided to go to court.

The Dzerzhinsky District Court of the city of Perm satisfied the requirements and ruled to recover from Aeroflot PJSC in favor of each of the family members (husband, wife and 2 children) 119.9 thousand rubles. The specified amount included the amount of money paid for tickets, compensation for the use of other people's money, a fine for non-fulfillment of consumer requirements on a voluntary basis and compensation for non-pecuniary damage - 25 thousand rubles each. to each.

The company then filed an appeal with the Perm Regional Court, which upheld the decision of the lower court.
